- Hermes and other AI models, agents, and inference tools made available by Nous;
- Nous APIs, developer tools, and related integrations;
- Our websites, including nousresearch.com and related subdomains;
- Community, support, research, and account management interactions; and
- Related online and offline interactions with Nous and our products and services
(collectively, the “Services”).
By using the Services, you agree to our collection and use of personal information as described in this Policy and in our Terms of Service.
This Privacy Policy does not cover the personal information we collect about employees and independent contractors or job applicants.
Personal Information We Collect – Sources and Types
When you interact with our Services, we collect your personal information from you when you visit our websites, request information from us, create an account, submit prompts, inputs, or other content, interact with our AI models or APIs, make purchases, or otherwise interact with us through the Services.
The information we collect through the Services may include:
- Personal identifiers and account information, such as name, username, email address, telephone number, billing address, account credentials, payment-related information, organization or company affiliation, and other information provided when creating or managing an account or communicating with us;
- Commercial and transaction information, such as records of subscriptions, purchases, payment history, account activity, pricing tier selections, and related transaction details;
- AI workflow data, such as prompts, instructions, messages, uploads, inputs, outputs, responses, conversation history, tool interactions, inference requests, API calls, telemetry, usage logs, and related interaction data generated through use of the Services;
- AI usage data, such as records regarding how models, agents, tools, or workflows interact with prompts, systems, APIs, environments, or tools, including intermediate actions, tool usage patterns, execution metadata, and related operational or diagnostic information;
- Internet or other electronic activity information, such as IP address, browser type, device identifiers, operating system, device characteristics, referral URLs, interaction with our Services, approximate location derived from IP address, pages viewed, links clicked, session activity, and information regarding interaction with advertisements or analytics tools;
- Communications and support information, such as contents of communications sent to us, support inquiries, survey responses, feedback, bug reports, community interactions, and related records; and
- Audio, visual, or similar information, such as profile images, recordings of support interactions, or other content provided.
We may also collect information from third-party services, integrations, analytics providers, payment processors, authentication providers, and infrastructure providers in connection with use of the Services.
If you create or access your account using a sign-in service provided by a third-party (a “Third-Party Sign-In Service”), we receive the information that service shares with us, such as your name, email address, profile picture and an identifier for your account with that service. We use this information to create, link, authenticate and secure your account and to prevent fraud, and we treat the email address as your account contact. The sign-in provider’s collection and use of your information is governed by its own terms of use and privacy policy.
How We Use Your Personal Information
We use the personal information obtained through the Services to provide, operate, maintain, support, and improve the Services and related products, features, and functionality; to provide information, products, and services requested or purchased; to authenticate users and administer accounts; to process transactions and payments; and to communicate regarding accounts, use of the Services, customer support matters, required notices, updates, security alerts, and other administrative or operational communications. We may also generate, use, disclose, license, distribute, or otherwise make available aggregated, anonymized, de-identified, synthetic, derivative, or similar data, datasets, analytics, insights, models, or related materials generated from use of the Services for research, analytics, commercial, operational, product development, artificial intelligence training, or other lawful business purposes, provided such information is not intended to identify particular users. Information we obtain from a third-party account you connect, or that we receive through a Third-Party Sign-In Service or your subscription or account with that service, is used and disclosed as described in the Connected Accounts and Integrations and Third-Party AI Models and Service Providers sections below and as permitted by the applicable provider’s terms.
We may also disclose personal information as required or permitted by law to comply with a subpoena or similar legal process or government request, or when we believe in good faith that disclosure is legally required or otherwise necessary to protect our or others’ rights, property, or safety, including to law enforcement agencies, and judicial and regulatory authorities. Additionally, we may disclose personal information to third parties to help detect and protect against fraud or data security vulnerabilities. And we may transfer or disclose personal information to a third party in the event of an actual or proposed sale, merger, reorganization of our entity or other restructuring.
Third-Party AI Models and Service Providers
Certain Services may utilize third-party artificial intelligence models, infrastructure providers, or other service providers to provide requested functionality. As a result, prompts, inputs, outputs, and related information submitted through the Services may be shared with such providers as necessary to provide the Services. These third-party providers process such information in accordance with their own terms, privacy policies, and practices. We encourage users to review the privacy policies of any third-party providers whose services are used in connection with the Services.
If a Third-Party Sign-In Service enables you to use your subscription or account with that service to access certain features of the Services, the prompts, inputs and related information you submit through those features are sent to that service under your account with it to generate responses, and we receive the responses, usage information and notices about your remaining usage. The service processes that information under its own terms of use and privacy policy, and your choices with that service (including any training opt-out) are managed in your account with it. We keep records of use under your subscription or account to operate the feature, for billing, and to investigate disputes, fraud or misuse.
Connected Accounts and Integrations
Some features let you connect third-party accounts (for example, email, calendar, code-hosting, messaging or productivity services) so that models and agents can retrieve information from, monitor, and take actions on those services at your direction. When you connect an account, we and our integration service providers receive and store access credentials for the account, the account identifier, the information retrieved from the service that is needed to carry out the actions or event subscriptions you set up, and logs of those actions. We use this information to provide, secure and support the connected-account features you use. You can disconnect an account at any time in your account settings or through the third-party service.
Cookies and Analytics
Cookies are small, sometimes encrypted text files that are stored on computer hard drives by websites that you visit. They are used to help users navigate websites efficiently as well as to provide information to the owner of the websites. You may set your browser to refuse cookies or alert you when cookies are being sent; some browsers have other cookie management tools.

Personal Information of Minors
Our products and services are not directed to children under the age of 13 (or the applicable age of digital consent in your jurisdiction, if higher) and we do not knowingly collect the personal information of such children. If we learn that we have collected personal information from such a child, we will take reasonable steps to delete that information or deactivate the account, as appropriate.
How We Keep Your Personal Information Secure
We implement and maintain reasonable security measures appropriate to the nature of the personal information that we collect, use, retain, transfer or otherwise process. Those measures include administrative, physical, and technical safeguards to protect the security, confidentiality, and integrity of personal information. However, data security incidents and breaches can occur due to a variety of factors that cannot reasonably be prevented; therefore, our safeguards may not always be adequate to prevent all breaches of security.
Your Privacy Choices and Opt-Out Rights
We provide users with the ability to limit certain uses of their personal information through the privacy controls made available within the Services. In particular, users may elect to enable “Privacy Mode,” which allows users to opt out of the storage and use of certain inference payloads for training, product improvement, and support purposes.
To enable Privacy Mode:
- Log in to your account at portal.nousresearch.com;
- Navigate to “Account Settings;”
- Locate the “Privacy Settings” section;
- Review the available privacy options; and
- Select “Privacy Mode”
Once Privacy Mode has been selected and the setting has been applied to your account, your preference will be reflected within the Privacy Settings interface. Privacy Mode limits our storage and use of inference payloads, such as prompts, inputs, uploads, messages, outputs, and responses. When Privacy Mode is enabled, we will not store your inference payloads and will not use such inference payloads for training, product improvement, or support purposes, except to the extent necessary to maintain security, integrity, and operation of the Services, comply with applicable law, or detect, prevent, or investigate fraud, abuse, or security incidents. Privacy Mode does not prevent us from collecting, storing, or using operational metadata where needed to provide, route, secure, operate, debug, bill for, or otherwise maintain the Services.
Privacy Mode governs Nous’s own storage and use of inference payloads. It does not change how third-party services process information you send to them under that service’s own terms, including through a Third-Party Sign-In Service or a subscription or a connected account provided by such a service, and it does not prevent us from keeping records of actions taken on your connected accounts at your direction where needed to provide, secure and support those features.
Please note that Privacy Mode may apply only on a prospective basis and may not affect information that was collected, processed, incorporated into models, or otherwise used prior to the activation of Privacy Mode. In addition, certain privacy settings or controls may apply only to particular Services or features. Enabling Privacy Mode may impact the functionality, personalization, or availability of certain features of the Services.
When We Do Not Act on a Request
In some cases, we may not act on requests (e.g., if we cannot do so in order to comply with applicable law). When this is the case, we will explain our reasons for not providing the information or taking the action requested.
Other Websites and Social Media Buttons
Our websites may contain links to other websites or social media buttons. We are not responsible for the privacy practices or the content of those websites or social media platforms. This Privacy Policy applies only to our business and the personal information we collect.
Changes to This Policy
If we make changes to this Privacy Policy, we post those changes on the website and update the date of the Privacy Policy. If the changes are material, you will be notified via a notice on our website.
